1. About us
These Terms and Conditions ("Terms") govern your use of the Childcare Buddy service ("Service"), operated by Childcare Buddy ("we", "us", "our"). By creating an account or otherwise using the Service, you ("you", "user") agree to these Terms and form a binding contract with Childcare Buddy.
2. Acceptance
By continuing to access or use the Service you confirm that you accept these Terms. If you do not agree, you must stop using the Service. If you use the Service on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.
3. The Service
Childcare Buddy provides software for managing childcare centres, including child records, attendance, billing, parent communication, and related tools. We may add, change, or remove features from time to time.
4. Your account
You must provide accurate information when creating your account and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.
5. Acceptable use
You must not misuse the Service. In particular, you must not:
- use the Service for any unlawful, fraudulent, or harmful purpose;
- send spam, malware, or other harmful code;
- infringe anyone else's intellectual property or privacy rights;
- probe, scan, scrape, or test the vulnerability of the Service or interfere with its security; or
- attempt to reverse engineer, resell, or redistribute the Service or circumvent any technical limits.
6. Intellectual property
We retain all right, title, and interest in and to the Service, including all software, documentation, branding, and other materials we provide. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms and your selected plan. You retain ownership of the content you upload, and you grant us a limited licence to host and process that content solely to provide the Service to you.
7. Payments, subscriptions, and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
The mechanics of payment, billing, taxes, renewals, cancellations, and refunds are governed by Paddle's Buyer Terms, available at paddle.com/legal/checkout-buyer-terms. Our own refund policy is set out on the Refunds page.
8. Service availability
We work hard to keep the Service running, but we do not guarantee that it will always be available or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
9. Suspension and termination
We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay amounts due, present a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the Service and cancel your subscription at any time through Paddle.
10. Liability
To the extent permitted by law, our total liability arising out of or relating to the Service is limited to the fees you paid to Paddle for the Service in the twelve (12) months before the event giving rise to the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where it cannot lawfully be excluded.
11. Changes to these Terms
We may update these Terms from time to time. If we make material changes we will notify you, for example by email or through the Service. Continued use after the changes take effect means you accept the updated Terms.
